Privacy Policy

Mi Casa El Pasa respects your privacy. This policy explains what personal information we collect, why we collect it, who we share it with and what rights you have. It is written to comply with the Protection of Personal Information Act 4 of 2013 (POPIA).

1. Who is responsible for your information

2. What we collect

  • Membership details: your first name, surname, email address, phone number and password.
  • Age verification: your South African ID number, used once to confirm you are 18 or older. We do not store your ID number. We keep only the fact that your age was verified.
  • Order and delivery details: what you bought, your billing and delivery address, delivery notes and order history.
  • Payment information: handled entirely by our payment provider. We receive confirmation that a payment succeeded or failed. We never see or store your card number.
  • Contact you send us: messages sent through the contact form, by email, by phone or on social media.
  • Technical information: IP address, browser and device type, pages visited and similar analytics collected through cookies.

We do not knowingly collect information from anyone under 18. If we learn that we have, we delete it.

4. Who we share it with

We do not sell your personal information. We share only what is needed, and only with:

  • Delivery partners: your name, address and phone number, so your order can reach you.
  • Our payment provider: to take payment securely.
  • Our hosting and email providers: they keep the website and our mail running.
  • Professional advisers such as accountants, where they need it to do their work.
  • Law enforcement or regulators, where the law requires it or to protect our rights.

Everyone who processes information on our behalf is required to keep it confidential and to use it only for the purpose we gave it to them.

5. Information sent outside South Africa

Some of the services we use, including website hosting, email and analytics, may store information on servers outside South Africa. Where that happens, we take reasonable steps to ensure the recipient is subject to laws or agreements providing protection substantially similar to POPIA, as section 72 requires.

6. How long we keep it

  • Order and invoice records: five years, as tax and company law require.
  • Membership accounts: for as long as your account is open. Ask us to close it and we will delete or anonymise what we are not legally required to keep.
  • Marketing consent: until you unsubscribe.
  • ID numbers: not retained at all, used once for age verification and discarded.

7. How we protect it

The site runs over an encrypted HTTPS connection, passwords are stored hashed rather than in plain text, and access to customer data is limited to people who need it. No system is perfectly secure, but if a breach affects your personal information we will notify you and the Information Regulator as POPIA requires.

8. Your rights

Under POPIA you may:

  • ask what personal information we hold about you, and get a copy;
  • ask us to correct or delete information that is wrong, misleading, excessive or out of date;
  • object to us processing your information in certain circumstances;
  • withdraw consent you previously gave, including for marketing;
  • complain to the Information Regulator.

Email sales@micasaelpasa.com and we will respond as quickly as we reasonably can. We may need to confirm your identity first.

If you are not satisfied with how we have handled your information, you may lodge a complaint with the Information Regulator of South Africa:

10. Cookies

Cookies are small files a website stores on your device. We use them to keep you logged in, remember what is in your cart, confirm you have passed the age gate, and understand which pages people find useful. Essential cookies are needed for the shop to work at all, and the cart and checkout will not function without them. You can block or delete cookies in your browser settings, accepting that parts of the site may then break.

11. Marketing

We will only send you marketing email if you have asked for it or are an existing customer buying similar products. Every marketing message carries an unsubscribe link, and you can also simply email us to stop. Order confirmations, delivery updates and account notices are not marketing. You receive those because you placed an order.

12. Access to information (PAIA)

You may request access to records we hold under the Promotion of Access to Information Act 2 of 2000. Send requests to our Information Officer, Leonie Schulz, at sales@micasaelpasa.com.

13. Changes to this policy

We may update this policy from time to time. The version on this page is the one that applies, and the date at the top tells you when it last changed.
